The Scottish Ministers make the following Order in exercise of the powers conferred by section 5(1) and (2) of, and paragraph 1(b) of Schedule 3 to, the Public Expenditure and Receipts Act 1968(1) and all other powers enabling them to do so.
1.—(1) This Order may be cited as the Registration of Births, Deaths and Marriages (Fees) (Scotland) Order 2010 and comes into force on 1st January 2011.
(2) In this Order a reference to a numbered column is to the column in the Schedule to this Order bearing that number.
2. The enactments in column 1 are amended by increasing the sum specified by that enactment as the amount or maximum amount payable in respect of the matter described in column 2 from the sum shown in column 3 to the sum shown in column 4.
3. The Registration of Births, Deaths and Marriages (Fees) (Scotland) Order 2009(2) is revoked.

This Order amends fees payable, under certain provisions of the Savings Bank Act 1887, the Factories Act 1961, the Education (Scotland) Act 1980 and the Social Security Administration Act 1992 for certificates of birth, death or marriage for the purposes of those Acts (article 2). The new fees are set out in the Schedule.
The Order also revokes the Registration of Births, Deaths and Marriages (Fees) (Scotland) Order 2009 (article 3).
1968 c.14; paragraph 1(b) of Schedule 3 was relevantly amended by section 136(2) of and paragraph 4 of Schedule 4 to the Education (Scotland) Act 1980 (c.44), section 4 of and paragraph 5 of Schedule 2 to the Social Security (Consequential Provisions) Act 1992 (c.6) and section 53(3) of the Local Electoral Administration and Registration Services (Scotland) Act 2006 (asp 14). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
Section 10 was amended by section 94 of, and Part III of Schedule 6 to, the Post Office Act 1969 (c.48) and sections 4(3) and 7(3) of, and Schedule 4 to, the Trustee Savings Bank Act 1985 (c.58) and is applied by regulation 26 of the Savings Certificates Regulations 1991 (S.I. 1991/1031) and regulation 25 of the Premium Savings Bonds Regulations 1972 (S.I. 1972/765). Section 10B was inserted by article 4(1) of, and paragraph 1 of Schedule 1 to, the Civil Partnership Act 2004 (Overseas Relationships and Consequential, etc. Amendments) Order 2005 (S.I. 2005/3129) and amended by section 53(1) of the Local Electoral Administration and Registration Services (Scotland) Act 2006 (asp 14) (“the 2006 Act”). The sums specified in sections 10 and 10B(2) were substituted most recently by S.S.I. 2009/65.
The fee specified in section 178 was substituted most recently by S.S.I. 2009/65.
The fee specified in section 84 was substituted most recently by S.S.I. 2009/65.
Section 124(1), to which section 124(3) refers, was amended by section 41(4) of, and paragraph 59 of Schedule 2 to, the Jobseekers Act 1995 (c.18), paragraph 13 of Schedule 2 to the State Pension Credit Act 2002 and paragraph 10(16) of Schedule 3 to the Welfare Reform Act 2007. Section 124B(1) was inserted by article 4(1) of, and paragraph 4 of Schedule 1 to, the Civil Partnership Act 2004 (Overseas Relationships and Consequential, etc. Amendments) Order 2005 (S.I. 2005/3129) and amended by section 53(2) of the 2006 Act. The sums specified in sections 124(3)(b) and 124B(1) were substituted most recently by S.S.I. 2009/65.
