The Housing (Scotland) Act 2010 (Commencement No. 1) Order 2010

The Scottish Ministers make the following Order in exercise of the powers conferred by section 166(2) of the Housing (Scotland) Act 2010(1).
Citation
1. This Order may be cited as the Housing (Scotland) Act 2010 (Commencement No. 1) Order 2010.
Appointed day
2. Section 143 (limitation on right to buy: new supply social housing) of the Housing (Scotland) Act 2010 comes into force on 3rd January 2011 only for the purpose of enabling regulations prescribing a form of notice under section 61F(2)(d) of the Housing (Scotland) Act 1987(2) to be made(3).

EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings section 143 of the Housing (Scotland) Act 2010 into force on 3rd January 2011 for the limited purpose of enabling the Scottish Ministers to make regulations prescribing a form of notice. Section 143 amends the Housing (Scotland) Act 1987 by inserting new section 61F. The power to make regulations is conferred by new section 61F(2)(d), as read with section 330.
The Housing (Scotland) Act 2010 received Royal Assent on 9th December 2010. Sections 161, 163 and 165 to 167 came into force on Royal Assent.
The power to make regulations is conferred by section 330 of the Housing (Scotland) Act 1987 and transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
