The Scottish Ministers make the following Order in exercise of the powers conferred by section 44(2)(b) of the Transport (Scotland) Act 2001(1) and all other powers enabling them to do so.

Citation and commencement

1.  This Order may be cited as the Bus Lane Contraventions (Approved Local Authorities) (Scotland) Order 2011 and comes into force on 6th February 2012.

Approved local authorities

2.  Each local authority listed in column (1) of the Schedule, whose area is wholly or partially designated by order under paragraphs 1(1) and 2(1) of Schedule 3 to the Road Traffic Act 1991(2) (permitted and special parking areas outside London), of which the reference number is given in column (2) of the Schedule, is an approved local authority for the purposes of section 44 of the Transport (Scotland) Act 2001 (civil penalties for bus lane contraventions).

EXPLANATORY NOTE

(This note is not part of the Order)

The Bus Lane Contraventions (Charges, Adjudication and Enforcement) (Scotland) Regulations 2011 (S.S.I. 2011/442) provide for the enforcement of bus lane restrictions through the imposition, by approved local authorities, of penalty charges in respect of contraventions of such restrictions.

This Order specifies the authorities listed in column (1) of the Schedule as approved local authorities for the purposes of section 44 of the Transport (Scotland) Act 2001.

The City of Aberdeen Council changed its name to Aberdeen City Council by resolution under section 23 of the Local Government etc. (Scotland) Act 1973 (which section was inserted by paragraph 92 of Schedule 13 to the Local Government etc. (Scotland) Act 1994) at a special meeting convened on 9th May 1995. The City of Glasgow Council changed its name to Glasgow City Council by resolution also under section 23 at a special meeting convened on 4th April 1996.

No Business Regulatory Impact Assessment has been undertaken, since the Order is concerned with the enforcement of existing traffic restrictions and prohibitions and does not therefore constitute an additional burden on business. The costs incurred by local authorities undertaking enforcement are expected to be defrayed by charge income.
