The Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) Amendment Regulations 2011

Coming into force
The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 16(1)(e), 17(1), 26(1)(a) and (3) and 48(1) of the Food Safety Act 19901 and all other powers enabling them to do so.
In accordance with section 48(4A) of that Act, the Scottish Ministers have had regard to relevant advice given by the Food Standards Agency2.
There has been consultation as required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety3.

Citation and commencement1.

These Regulations may be cited as the Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) Amendment Regulations 2011 and come into force on 14th March 2011.

Amendment of the Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) (No. 2) Regulations 20072.

The Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) (No. 2) Regulations 20074 are amended as follows.

In regulation 3(1)(a), for “Veterinary Medicines Regulations 20055” substitute “the Veterinary Medicines Regulations 20096”.

(3)

After regulation 3, insert—

“Additional language3A.

Nothing in these Regulations prevents a bottle being marked or labelled with any other language in addition to English.”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations amend the Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) (No. 2) Regulations 2007 by—

(a)

updating a reference in regulation 3(1)(a) to the Veterinary Medicines Regulations 2009 (regulation 2(2)); and

(b)

providing that languages in addition to English may be marked or labelled on a bottle (regulation 2(3)).

A Business and Regulatory Impact Assessment has not been prepared for this instrument as it has no impact on the cost of business.
