10.—(1) The Adoption Agencies (Scotland) Regulations 2009(1) are amended as follows.
(2) In regulation 13 (adoption agency decisions)—
(a)in paragraph (5) for “supervision requirement” substitute “compulsory supervision order”; and
(b)in paragraph (6) for “in accordance with” to “supervision requirement)” substitute “that the circumstances mentioned in section 131(2)(c)(i) or (d) of the Children’s Hearings (Scotland) Act 2011 (duty of implementation authority to require review)(2) exist and”.
(3) In regulation 23 (application for a permanence order: child subject to supervision requirement)—
(a)in paragraph (1) for “supervision requirement” substitute “compulsory supervision order”;
(b)in paragraph (3)(b) for “section 73(13) of the 1995 Act” substitute “section 141(2) of the Children’s Hearings (Scotland) Act 2011 (“the 2011 Act”)(3)”; and
(c)in paragraph (4) for “section 73(13) of the 1995 Act” substitute “section 141(2) of the 2011 Act”.
