The Scottish Ministers make the following Order in exercise of the powers conferred by section 38(1) of the Water Environment and Water Services (Scotland) Act 2003(1).
1. This Order may be cited as the Water Environment and Water Services (Scotland) Act 2003 (Commencement No. 9) Order 2013 and comes into force on 21st September 2013.
2. 21st September 2013 is the appointed day on which section 23 (fixing of charges for water services) of the Water Environment and Water Services (Scotland) Act 2003 comes into force.

This Order brings into force section 23 of the Water Environment and Water Services (Scotland) Act 2003 (“the Act”) on 21st September 2013. Section 23 of the Act empowers the Scottish Ministers to make regulations containing provision for or in connection with the fixing of charges for the provision of water services for the purposes of the protection of the water environment.
The Bill for the Act received Royal Assent on 5th March 2003. Part 3 (sections 35 to 38) of the Act also came into force on that day.

Section 24(5) to (7) of the Water Environment and Water Services (Scotland) Act 2003 was repealed by section 56 of, and the schedule to, the Planning etc. (Scotland) Act 2006 (asp 17) with effect from 1st April 2007.
