EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations replace and revoke the Overhead Lines (Exemption) Regulations 1990 (“the 1990 Regulations”) in relation to their application to Scotland.

These Regulations make provision in relation to Scotland for the cases where the consent of the Scottish Ministers is not required under section 37 of the Electricity Act 1989 (“the 1989 Act”) for the installation, or keeping installed, of an electric line above ground. The cases are specified in regulation 3 subject in certain circumstances to the limitations in regulation 4 and to the restriction in regulation 5. These Regulations replicate with minor modifications the 1990 Regulations. The minor changes exclude the application of the exemption contained in regulations 3(1)(c) and (e) where the overhead line is within a European site and, in regulation 3(1)(f) extend the exemptions to include the installation of additional supports for existing lines. Regulation 6(1) revokes the 1990 Regulations but where those Regulations disapplied section 37(1) of the 1989 Act in relation to an electric line installed before 1st November 2013, regulation 6(2) again disapplies that section in relation to that electric line.
