The Health Boards (Membership and Elections) (Scotland) Order 2013

Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by sections 4(1) and 10(2) of the Health Boards (Membership and Elections) (Scotland) Act 20091 and all other powers enabling them to do so.

In accordance with section 4(4) of that Act2, a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement1

This Order may be cited as the Health Boards (Membership and Elections) (Scotland) Order 2013 and comes into force on 31st December 2013.

Revocation of the Health Boards (Membership and Elections) (Scotland) Act 2009 (Commencement No. 1) Order 20092

The Health Boards (Membership and Elections) (Scotland) Act 2009 (Commencement No. 1) Order 20093 is revoked.

Incidental, consequential and saving provision3

Notwithstanding article 2, section 1(1) to (5) and (7) of the Act continues in force for the specified areas.

Section 6(4) of the Act has effect only in respect of the specified areas.

In this article—

  • the Act” means the Health Boards (Membership and Elections) (Scotland) Act 2009;

  • “specified areas” means the areas for which—

    1. a

      Fife Health Board; and

    2. b

      Dumfries and Galloway Health Board,

are constituted4.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order revokes the Health Boards (Membership and Elections) (Scotland) Act 2009 (Commencement No. 1) Order 2009, which commenced sections 1 to 3 of the Health Boards (Membership and Elections) (Scotland) Act 2009 in respect of Fife and Dumfries and Galloway Health Board areas for the purpose of piloting Health Board elections in those areas. This Order brings the pilot scheme to an end in terms of section 6 of the 2009 Act. The Order also makes incidental, consequential and saving provision.
