The Scottish Ministers make these Regulations in exercise of the powers conferred by sections 88, 88A(3) and (4) and 96(2) of, and paragraphs 3 and 4 of schedule 1A to, the Climate Change (Scotland) Act 2009(1) and all other powers enabling them to do so.

In accordance with section 96(4) of that Act(2), a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
