Article 2 of this Order brings into force section 1(1) and, for certain purposes, section 1(2) and paragraph 2 of Schedule 1 to the 2010 Act.
Section 1(1) of the Act establishes a body corporate to be known as the “Scottish Sentencing Council”. Section 1(2) introduces Schedule 1 for the purposes of commencing paragraph 2 of Schedule 1 to the 2010 Act.
Paragraph 2 of Schedule 1 is commenced for the purposes of enabling the Scottish Ministers to make regulations regarding the procedures to be followed for a person to be nominated, or otherwise selected for appointment, as a member of the Scottish Sentencing Council
The Criminal Justice and Licensing (Scotland) Act 2010 (“the 2010 Act”) received Royal Assent on 6th August 2010. Sections 201, 202, 204 and 206 of the Act came into force on Royal Assent.
