Weighing of fisheries products: landing of certain pelagic species in specified ports21.
(1)
Pursuant to Article 79(2) of the Implementing Regulation, any fishing boat that lands a controlled catch in Scotland must do so in a port specified in a list which must be maintained, and may be updated from time to time, by the Scottish Ministers M1.
(2)
The person in charge of the boat commits an offence if there is a failure to comply with paragraph (1).
(3)
In this article—
(a)
“controlled catch” means any catch (or combination of catches) which falls within the scope of Article 78 of the Implementing Regulation; and
(b)
“person in charge” means each of the following persons—
(i)
the master;
(ii)
the owner;
(iii)
the charterer (if any).
