18. These Regulations do not apply to the procurement for the award of a concession contract by a utility if the contract is intended to enable an activity referred to in regulation 32 (activities directly exposed to competition) of the Utilities Contracts (Scotland) Regulations 2016(1) to be carried out and that activity is or is established to be directly exposed to competition in accordance with that regulation.
