Exclusion of activities which are directly exposed to competitionI118

These Regulations do not apply to the procurement for the award of a concession contract by a utility if the contract is intended to enable an activity referred to in regulation 32 (activities directly exposed to competition) of the Utilities Contracts (Scotland) Regulations 201631 to be carried out and that activity is or is established to be directly exposed to competition in accordance with that regulation.
