3. In section 12B(2)(b) and (3)(c) (transitional power of Secretary of State as respects proposed roads)(1) for “environmental statement” in each place where it occurs substitute “EIA report”.
Section 12B was inserted by section 38(2) of the Local Government etc. (Scotland) Act 1994 (c.49) (“the 1994 Act”) and amended by paragraph 38 of schedule 2 of the Planning (Consequential Provisions) (Scotland) Act 1997 (c.11).
