The Functions of Health Boards (Scotland) Amendment Order 2017

The Scottish Ministers make the following Order in exercise of the powers conferred by section 2(1)(a) and 105(7) of the National Health Service (Scotland) Act 1978(1) and all other powers enabling them to do so.

Sections 2 was amended by: the Health and Social Services and Social Security Adjudications Act 1983 (c.41) (“the 1983 Act”), schedule 7, paragraph 1; the National Health Service and Community Care Act 1990 (c.19), section 28; the National Health Service (Primary Care) Act 1997 (c.46) (“the 1997 Act”), section 10; the Smoking, Health and Social Care (Scotland) Act 2005 (asp 13) schedule 2, paragraph 2(2); and National Health Service Reform (Scotland) Act 2004 (asp 7), schedule 1, paragraph 1(2)(a). Section 105(7) was amended by: the Health Service Act 1980 (c.53), schedule 6, paragraph 5 and schedule 7; the 1983 Act, schedule 9, paragraph 24; and the Health Act 1999 (c.8). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
