The Representation of the People (Absent Voting at Local Government Elections) (Scotland) Amendment Regulations 2017

Coming into force

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 33 and 61(2) of the Local Electoral Administration and Registration Services (Scotland) Act 20061 and all other powers enabling them to do so.

Citation and commencement1

These Regulations may be cited as the Representation of the People (Absent Voting at Local Government Elections) (Scotland) Amendment Regulations 2017 and come into force on 23rd April 2017.

Amendment of the Representation of the People (Absent Voting at Local Government Elections) (Scotland) Regulations 20072

In the Representation of the People (Absent Voting at Local Government Elections) (Scotland) Regulations 20072, after paragraph (4)(a) of regulation 11 (closing date for applications) insert—

on grounds relating to the applicant’s occupation, service or employment and the applicant became aware of those grounds after 5 p.m. on the sixth day before the date of the poll at the election for which it is made;

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend regulation 11 of the Representation of the People (Absent Voting at Local Government Elections) (Scotland) Regulations 2007. They allow for an application for a proxy vote to be accepted if received no later than 5 p.m. on the day of the poll where the application is made on grounds relating to the applicant’s occupation, service or employment and the applicant became aware of those grounds after 5 p.m. on the sixth day before the poll.
