The Food and Feed Safety (Fukushima Restrictions) (Scotland) Revocation Regulations 2022

The Scottish Ministers make the following Regulations in exercise of the powers conferred on them by Articles 53(1)(b)(ii) and 57a(6) of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(1), and all other powers enabling them to do so.

There has been consultation as required by Article 9 of that Regulation.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Food and Feed Safety (Fukushima Restrictions) (Scotland) Revocation Regulations 2022, and come into force on 25 June 2022.

(2) These Regulations extend to Scotland only.

Revocation of Commission Implementing Regulation (EU) 2016/6

2.  Commission Implementing Regulation (EU) 2016/6 of 5 January 2016 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station and repealing Implementing Regulation (EU) No. 322/2014(2) is revoked.

Revocation of Declaration OFFC 2019/S/003

3.  Declaration OFFC 2019/S/003(3) is revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations which extend to Scotland only revoke Commission Implementing Regulation (EU) 2016/6 which imposes enhanced controls on the import of certain food and feed from Japan as a result of the Fukushima nuclear accident. These Regulations also revoke Declaration OFFC 2019/S/003 which was made in terms of regulation 35 of the Official Feed and Food Controls (Scotland) Regulations 2009 and which also imposed controls on the import of certain food and feed from Japan as a result of the Fukushima nuclear accident.
