3.—(1) The National Assistance (Assessment of Resources) Regulations 1992(1) are amended in accordance with paragraphs (2) and (3).
(2) In regulation 2 (interpretation)—
(a)after the definition of “the Act” insert—
““adult disability payment” means disability assistance for adults given in accordance with the Adult Disability Payment Regulations,
“Adult Disability Payment Regulations” means the Disability Assistance for Working Age People (Scotland) Regulations 2022(2),”,
(b)in the definition of “short-term assistance” after “Regulations” insert “or Part 1 of schedule 2 of the Adult Disability Payment Regulations”.
(3) In Part 1 of schedule 3 (sums to be disregarded)—
(a)in paragraph 4, after the second occurrence of “mobility component of child disability payment” insert “, the mobility component of adult disability payment or any payment of short-term assistance where the “earlier determination” mentioned in paragraph 1(1)(a) of Part 1 of schedule 2 (short-term assistance) of the Adult Disability Payment Regulations awarded the mobility component of adult disability payment”,
(b)in paragraph 6—
(i)at the end of sub-paragraph (d) omit “or”,
(ii)after sub-paragraph (e) insert—
“,
(f)the daily living component of adult disability payment, or
(g)any payment of short-term assistance where the “earlier determination” mentioned in paragraph 1(1)(a) of Part 1 of schedule 2 (short-term assistance) of the Adult Disability Payment Regulations awarded the daily living component of adult disability payment”.
