The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 50 and paragraphs 1(1) and 2(2) of schedule 4 of the Environment Act 2021 (“the Act”)(1) and all other powers enabling them to do so.

The Scottish Ministers have consulted in accordance with paragraph 8 of schedule 4 of the Act and are satisfied as to the matters specified in paragraph 9(1) of schedule 4 of the Act.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) Amendment (Scotland) Regulations 2022 and come into force on 1 January 2023.

(2) These Regulations extend to Scotland only.

Amendment of the Producer Responsibility Obligations (Packaging Waste) Regulations 2007

2.—(1) In schedule 2 (recycling obligations) of the Producer Responsibility Obligations (Packaging Waste) Regulations 2007(2)—

(a)for paragraph 5, substitute—

5.  The percentage which is prescribed as the recycling target “X” for the year 2023 is 77%.,

(b)in paragraph 6—

(i)for “years” substitute “year”,

(ii)for Table 2 substitute—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (S.I. 2007/871). Those Regulations impose on producers obligations to recycle packaging waste in order to attain overall recycling and material-specific recycling targets.

These Regulations set an overall recycling target as well as material-specific recycling targets for 2023 on obligated producers in Scotland in relation to glass, plastic, aluminium, steel, paper/board and wood.
