The Scottish Ministers make the following Order in exercise of the powers conferred by sections 4(4), 10(1) and 10A(1) of the Rehabilitation of Offenders Act 1974(1) and all other powers enabling them to do so.
In accordance with section 10(2) of that Act(2), a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1974 c. 53 (“the 1974 Act”). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46) and S.I. 2003/415. Section 10A of the 1974 Act was inserted by section 32 of the Management of Offenders (Scotland) Act 2019 (asp 14).
Section 10(2) was modified by paragraph 5 of schedule 3 of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).
