The Regulation of Investigatory Powers (Communications Data: Additional Public Authorities) Order 2002

Coming into force

Whereas a draft of this Order has been approved by resolution of each House of Parliament;

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by paragraph (g) of the definition of “relevant public authority” in section 25(1) of the Regulation of Investigatory Powers Act 20001, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Regulation of Investigatory Powers (Communications Data: Additional Public Authorities) Order 2002 and shall come into force on 1st August 2002.

Additional Public Authorities2

The public authorities set out in the Schedule to this Order are hereby specified as relevant public authorities for the purposes of section 25(1) of the Regulation of Investigatory Powers Act 2000.

Any local authority within the meaning of section 1 of the Local Government Act 19992.

Any fire authority as defined in the Local Government (Best Value) Performance Indicators Order 20003.

A council constituted under section 2 of the Local Government etc. (Scotland) Act 19944.

A district council within the meaning of the Local Government Act (Northern Ireland) 19725.

This Order specifies additional public authorities for the purposes of section 25(1) of the Regulation of Investigatory Powers Act 2000 (“the 2000 Act”). Public authorities specified for the purposes of section 25 are entitled to obtain communications data under the provisions set out in Chapter II of Part I of the 2000 Act.
