3. An offence under section 9(1)(a) of that Act(1) (burglary) if it was committed with intent to commit an offence of stealing anything in the building or part of a building in question.

Section 9 was amended by sections 139 and 140 of and paragraph 17 of Schedule 6 and Schedule 7 to the Sexual Offences Act 2003 (c. 42); section 26(2) of the Criminal Justice Act 1991 (c. 53) and section 168(2) and paragraph 26 of Schedule 10 to the Criminal Justice and Public Order Act 1994 (c. 33).
