This Order amends section 37(2) of the Criminal Justice Act 1982 (c. 48), which sets out the standard scale of fines for summary offences. The amendments substitute, for the sums specified as levels 1 to 4 on the standard scale, sums which are in each case 400% of the previous sums. Level 1 therefore becomes £800; level 2 becomes £2,000; level 3 becomes £4,000; and level 4 becomes £10,000.
This Order does not affect fines for offences committed before it comes into force (by virtue of section 87(5) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (c. 10) (“the Act”). See, in that regard, section 87(7). Nor does it affect level 5 on the standard scale, as to which provision is made by section 85(1) and (2) of the Act.
