This regulation applies where the relevant CFD unit is or is to be an offshore generating station or part of such a station.

The applicant must demonstrate that a lease or an agreement for lease has been granted by the Crown Estate in respect of the location of the relevant CFD unit.

In this regulation, “offshore generating station” means a generating station which is located wholly in offshore waters.
