17. In Article 21(5)—
(a)omit “and notwithstanding Directive 2002/58/EC(1),”;
(b)at the end insert “, notwithstanding domestic law made before exit day implementing Directive 2002/58/EC of the European Parliament and of the Council of 12th July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector”(2).

Such domestic legislation includes the Privacy and Electronic Communications (EC Directive) Regulations 2003 (S.I. 2003/2426) (“PECR”) and the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000 (S.I. 2000/2699) (as amended by PECR).
