The Secretary of State makes these Regulations in exercise of the powers conferred by—
section 2(2) of the European Communities Act 19721;
section 8(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 20182.
The Secretary of State has been designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to the environment3, the prevention, reduction and elimination of pollution caused by waste4 and the control of the import and export of goods5.
In accordance with paragraph 2(2) of Schedule 2 to the European Communities Act 1972 and paragraph 1(3) of Schedule 7 to the European Union (Withdrawal) Act 2018, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.
