The Secretary of State, in exercise of the powers conferred by sections 205(1), 208(8), 211(3) and (5) to (7), 214(4), 215(1) and (3), 216(5), (6) and (7), 216A(1) and (7), 217(3), 218(1), (3) and (4), 220(1) to (3), 222(1) and 223(1) of the Planning Act 2008(1), with the consent of Treasury, makes the following Regulations.
A draft of these Regulations has been laid before the House of Commons in accordance with section 222(2)(b) of the Planning Act 2008 and approved by resolution of that House.
2008 c.29. Most of the functions of the Secretary of State under Part 11 of the Act, in relation to Wales, were transferred to Welsh Ministers by article 44 of S.I. 2018/644. Section 216 was amended by section 115 of the Localism Act 2011 (c. 20) and regulation 63 of S.I. 2010/948, and section 216A was inserted by section 115 of the Localism Act 2011. There are amendments to sections 205, 211 and 218 which are not relevant to this instrument.
