Hospitals and small emitters: failure to pay civil penalty for exceeding emissions target55

Where the operator of an installation fails to pay a civil penalty (the “first penalty”) under article 54 on or before the due date set out in the penalty notice imposing the first penalty, the operator is liable to a further civil penalty.

The further civil penalty is—
a
10% of the first penalty; and
b
a daily penalty at a daily rate of £150 for each day that the operator fails to pay the first penalty beginning with the day on which the initial notice is given, up to a maximum of £13,500.
