The Secretary of State makes this Order in exercise of the powers conferred by sections 87(1)(b) and 89A of the Natural Environment and Rural Communities Act 2006(1) “the 2006 Act”.

In accordance with section 97(5) of the 2006 Act the Secretary of State has consulted with such organisations as appear to the Secretary of State to be representative of interests substantially affected by this Order.

In accordance with section 89A(2) of the 2006 Act, the Secretary of State makes the Order with the approval of the Welsh Ministers, the Department of Agriculture, Environment and Rural Affairs in Northern Ireland and the Scottish Ministers.

In accordance with section 97(8)(a) of the 2006 Act, a draft of this Order has been laid before Parliament and approved by a resolution of each House of Parliament.

Title and commencement

1.—(1) This Order may be cited as the Agriculture and Horticulture Development Board (Amendment) Order 2020.

(2) This Order comes into force on the day after the day on which it is made.

Amendment of the Agriculture and Horticulture Development Board Order 2008

2.—(1) The Agriculture and Horticulture Development Board Order 2008(2) is amended as follows.

(2) In Schedule 1 (functions of the Agriculture and Horticulture Development Board), after paragraph 20 insert—

21.  Collecting, managing and making available information regarding the identification, movement and health of animals.

22.  Allocating unique identification codes to the means of identifying animals in England and Wales.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made in exercise of powers conferred by the Natural Environment and Rural Communities Act 2006 (c. 16). It assigns two additional functions to the Agriculture and Horticulture Development Board (the Board). It enables the Board to manage a database covering the identification, movement and health of animals. It also enables the board to allocate unique identification codes for use by manufacturers of means of identifying animals, such as ear tags.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.

2006 c. 16. Section 89A was inserted by section 34 of the Agriculture Act 2020 (c. 21). Section 96 defines “the appropriate authority” to mean the Secretary of State, for the purposes of orders made under section 87(1)(b).
