14. The Motor Fuel (Composition and Content) and the Biofuel (Labelling) (Amendment) Regulations 2021(1) are revoked.
S.I 2021/199. This instrument was treated as if it were subject to the negative resolution procedure. However, as it amended provision made under section 2(2) of the European Communities Act 1972 (c. 68) (“the 1972 Act”), paragraph 13(1) of Schedule 8 to the European Union (Withdrawal) Act 2018 (c. 16) (“the 2018 Act”) applies. This provides that a statutory instrument which amends or revokes any subordinate legislation made under section 2(2) of the 1972 Act using a power conferred before the beginning of the parliamentary session in which the 2018 Act was passed, may not be made unless a draft of the instrument has been laid before, and approved by a resolution of each House of Parliament. To reflect these issues relating to the validity of S.I. 2021/199, this instrument contains a statement that S.I. 2021/199 is revoked.
