2.—(1) The amount specified for the purposes of section 39(2A) (court reviews: cap on damages) of the Sanctions and Anti-Money Laundering Act 2018 is £10,000.
(2) Paragraph (1) does not apply where the court considers that it is necessary to disapply that paragraph because failure to do so would be a breach of the appropriate person’s(1) Convention rights (within the meaning of the Human Rights Act 1998(2)).
“Appropriate person” is defined in section 38(3) of the Sanctions and Anti-Money Laundering Act 2018.
