A draft of this Order was laid before and approved by resolution of each House of Parliament in accordance with section 17(2) of the Civil Contingencies Act 2004(1) (“the Act”).
The Chancellor of the Duchy of Lancaster, in exercise of the power conferred by section 13(1)(a) of the Act, makes the following Order.
The Chancellor of the Duchy of Lancaster has consulted the Scottish Ministers and the Welsh Ministers in accordance with sections 14(1) and 14B(1)(2) of the Act respectively.
1.—(1) This Order may be cited as the Civil Contingencies Act 2004 (Amendment of List of Responders) Order 2023.
(2) This Order comes into force on the 22nd day after the day on which it is made.
(3) This Order extends to England and Wales, Scotland and Northern Ireland.
2. In Part 3 (Category 2 Responders: General) of Schedule 1 to the Civil Contingencies Act 2004, after paragraph 29B(3) insert—
“29C. The Coal Authority.
29D. The Secretary of State, in so far as the functions of the Secretary of State include the activities of the Meteorological Office.”

This Order amends the Civil Contingencies Act 2004 (c. 36) (“the Act”) by adding the Coal Authority and the Secretary of State, in so far as the functions of the Secretary of State include the activities of the Meteorological Office, to the list of general category 2 responders in Part 3 of Schedule 1 to the Act.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen. A de minimis assessment has been prepared.
