Coming into force in accordance with regulation 2
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 1(4), 14(1) and 20(1) of the Retained EU Law (Revocation and Reform) Act 2023 (“the Act”)(1).
The Secretary of State is a relevant national authority for the purposes of sections 1(4) and 14(1) of the Act(2).
In accordance with paragraph 5(1) and (5) of Schedule 5 to the Act, a draft of this instrument has been laid before, and approved by a resolution of, each House of Parliament.
1. These Regulations may be cited as the Retained EU Law (Revocation and Reform) Act 2023 (Revocation and Sunset Disapplication) Regulations 2023.
2.—(1) Subject to paragraphs (2) and (3), these Regulations come into force on the day after the day on which they are made.
(2) Regulation 4 and Schedule 1 come into force immediately before the end of 2023.
(3) Regulations 5 and 6 and Schedule 2 come into force at the end of 2023.
3.—(1) Subject to paragraphs (2) to (4), these Regulations extend to England and Wales, Scotland and Northern Ireland.
(2) The specification by regulation 4 of an instrument listed in Parts 1 and 2 of Schedule 1 has the same extent as the instrument to which it relates.
(3) The specification by regulation 4 of an instrument listed in Part 3 of Schedule 1 extends to Northern Ireland only.
(4) The revocation by regulation 5 of an instrument or a provision of an instrument listed in Schedule 2 has the same extent as the instrument or provision to which it relates.
(5) In these Regulations, “the Act” means the Retained EU Law (Revocation and Reform) Act 2023(3).
4.—(1) The instruments listed in Schedule 1 are specified for the purposes of section 1(4) of the Act (sunset of EU-derived subordinate legislation and retained direct EU legislation).
(2) In that Schedule—
(a)Part 1 lists subordinate legislation;
(b)Part 2 lists retained direct EU legislation;
(c)Part 3 lists retained direct EU legislation, which in accordance with regulation 3(3) is specified only insofar as it extends to Northern Ireland.
5.—(1) The instruments listed in Schedule 2 are revoked to the extent specified.
(2) In that Schedule—
(a)Part 1 lists subordinate legislation;
(b)Part 2 lists retained direct EU legislation.
6.—(1) In this regulation—
(a)the “2012 Act” means the Legal Aid, Sentencing and Punishment of Offenders Act 2012(4);
(b)the “2013 Regulations” means the Civil Legal Aid (Merits Criteria) Regulations 2013(5).
(2) The revocation of any provision of the 2013 Regulations by these Regulations—
(a)does not affect the application of paragraph 1(a) of Article 69 of the EU withdrawal agreement(6); and
(b)the revoked provisions continue to have effect for the purposes of that paragraph.
(3) Paragraph (4) applies to a determination made before the end of 2023 by the Director of Legal Aid Casework, in accordance with Part 1 of the 2012 Act, that an individual qualifies for civil legal services.
(4) In relation to a determination to which this paragraph applies, the revocation of any provision of the 2013 Regulations by these Regulations—
(a)does not affect the application of section 11 of the 2012 Act; and
(b)the revoked provisions continue to have effect for the purposes of that section.

Section 1(1) of the Retained EU Law (Revocation and Reform) Act 2023 (c. 28) (“the Act”) and Schedule 1 to that Act revoke specified subordinate legislation and specified retained direct EU legislation at the end of 2023. These Regulations are made in exercise of the powers in sections 1(4) and 14(1) of the Act. These are the power to disapply the sunset of retained EU law to specified instruments (section 1(4)) and the power to revoke specified retained EU law (section 14(1)) and which by virtue of section 20(1) include the ability to make supplementary, incidental, consequential, transitional, transitory or saving provision.
Regulations 1 to 3 (citation, commencement, and extent and interpretation) come into force on the day after these Regulations are made. Regulation 4 and Schedule 1 (disapplication of the sunset) come into force immediately before the end of 2023. Regulations 5 and 6 and Schedule 2 (revocation of REUL and necessary savings) come into force at the end of 2023.
Regulation 3 provides that the Regulations extend to England and Wales, Scotland and Northern Ireland, subject to paragraphs (2) to (4). Paragraph (2) provides that for instruments listed in Parts 1 and 2 of Schedule 1, the disapplication of the sunset has the same extent as the instrument to which it relates. Paragraph (3) provides that for those instruments listed in Part 3 of Schedule 1, the extent of the disapplication is Northern Ireland only. Paragraph (4) provides that the revocation of an instrument or provision of an instrument in Schedule 2 has the same extent as the instrument to which it relates.
Regulation 4 provides that the sunset of subordinate legislation and retained direct EU legislation by section 1(1) of the Act and listed in Schedule 1 to that Act does not apply to the instruments listed in Schedule 1 to these Regulations, to the extent specified there. This has the effect of preserving the instruments, which were included in the Act’s revocation Schedule, from revocation at the end of 2023.
Regulation 5 provides that the instruments and provisions of instruments listed in Schedule 2 to these Regulations are revoked at the end of 2023, to the extent specified there.
Regulation 6 contains savings of provisions in the Civil Legal Aid (Merits Criteria) Regulations 2013 and the Legal Aid, Sentencing and Punishment of Offenders Act 2012 which apply to legal aid applications made before a certain date. The purpose of these savings is to ensure that the criteria set out in the relevant provisions of the 2013 Regulations continue to have effect for the purpose of determining whether an individual continues to qualify for civil legal services in ongoing cases.

“EU withdrawal agreement” is defined in Schedule 1 (definitions relating to the EU and the United Kingdom's withdrawal) to the Interpretation Act 1978 (c. 30) and means the withdrawal agreement within the meaning of the European Union (Withdrawal) Agreement Act 2020 (c. 1) (see section 39(1) and (6) of that Act).
