Such Penalty and Costs shall be levied by Poinding or Distress and Sale of the Goods, Chattels, and Effects of the Party liable to pay the same; and the Overplus arising from the Sale of such Goods, Chattels, and Effects, after satisfying such Penalty and Costs and the Expenses of the Poinding or Distress and Sale, shall be returned on Demand to the Party whose Goods, Chattels, or Effects shall have been poinded or distrained.
