11Powers of entry

(1)Any person duly authorised in writing by a highway authority may enter on any land—

(a)for the purpose of surveying it in connection with the making of a scheme or order under this Act;

(b)where an order under section three of this Act so provide for purposes connected with the carrying out of an works in pursuance of the scheme or of any order under that section, or the removal of any temporary work so carried out.

(2)Subsections (4), (5), (6) and (9) of section one hundred an three of the Town and Country Planning Act, 1947 (which contain supplementary provisions relating to the power of entry conferred by that section) shall apply in relation to the power conferred by this section as they apply in relation to the powers conferred by that section.

(3)Where in the exercise of a power of entering land conferred by this section (including the carrying out or removal c any such works as aforesaid), any damage has been caused t land or to chattels, any person interested in the land or chattel may recover compensation in respect of that damage from the authority by whom or on whose behalf the power was exercised and where in consequence of the exercise of such a power an; person is disturbed in his enjoyment of any land or chattels he may recover from that authority compensation in respect of the disturbance.

(4)In the application of this section to Scotland, for the reference to subsections (4), (5), (6) and (9) of section one hundred and three of the Town and Country Planning Act, 1947, there shall be substituted a reference to subsections (4), (5), (6) and (9) of section ninety-nine of the Town and Country Planning (Scotland) Act, 1947, and the expression " chattels " mean corporeal moveables.
