46 Regulations and orders.

The Secretary of State may make regulations for the purpose of prescribing anything which is authorised or required to be prescribed under this Act.

The power to make regulations under this Act shall be exercisable by statutory instrument; and any statutory instrument containing regulations made under this Act shall be subject to annulment in pursuance of a resolution of either House of Parliament.

Any power to make an order conferred by any of the provisions of this Act shall include a power, exercisable in the like manner and subject to the like conditions, to vary or revoke the order.

The power to make an order conferred by section 1 of this Act shall be exercisable by statutory instrument.

A statutory instrument containing an order under section 1 of this Act shall be subject to annulment in pursuance of a resolution of either House of Parliament if—

a

the order is one designating an area as the site of a proposed new town, or designating an additional area of not less than 500 acres which would extend the area of a new town by not less than ten per cent; and

b

an objection to the order was duly made by a local planning authority and had not been withdrawn at the time the order was made.

An order under section 35(5) or F136E of this Act shall be of no effect until it is approved by a resolution of the Commons House of Parliament.
