44 Appeals from police decisions under Part II.E+W+S

(1)An appeal under section 26, 29, 30, 34, 36, 37 or 38 of this Act lies, in England and Wales, to [F1the Crown Court] and, in Scotland, in accordance with Act of Sederunt to the sheriff.

(2)In relation to an appeal specified in the first column of Part I of Schedule 5 to this Act—

(b)the third column shows, for Scotland, the sheriff,

having jurisdiction to entertain the appeal.

(3)The procedural and other provisions contained in Part II of Schedule 5 to this Act shall have effect (for England and Wales only) on an appeal to [F1the Crown Court] under any provision of this Part of this Act.
