9E+W+SSummary proceedings in Scotland for an offence under paragraph 7 of this Schedule shall not be commenced after the expiration of three years from the commission of the offence, but subject to the foregoing limitation and notwithstanding anything in [F1section 331 of the M1Criminal Procedure (Scotland) Act 1975] such proceedings may be commenced at any time within twelve months after the date on which evidence sufficient in the opinion of the Lord Advocate to justify the proceedings comes to his knowledge or, where such evidence was reported to him by the Minister, within twelve months after the date on which it came to the Minister’s knowledge; and [F1subsection (3) of the said section 331] shall apply for the purposes of this paragraph as it applies for the purposes of that section.
