35Application to Scotland
In the application of this Part of this Act in Scotland—
(a)
" the court" means the sheriff, and any application to the sheriff under this Part of this Act shall be disposed of in a summary manner ; and
(b)
" mortgagee " means creditor in a heritable security, and " heritable security " has the same meaning as in the M1Conveyancing (Scotland) Act 1924 except that it includes a security constituted by ex facie absolute disposition or assignation.
