[F125B Assisting entry to United Kingdom in breach of deportation or exclusion orderU.K.

(1)A person commits an offence if he—

(a)does an act which facilitates a breach [F2or attempted breach ] of a deportation order in force against an individual who is a citizen of the European Union, and

(b)knows or has reasonable cause for believing that the act facilitates a breach [F2or attempted breach] of the deportation order.

[F3(2)Subsection (3) applies where the Secretary of State has made an order excluding an individual from the United Kingdom on the grounds of public policy, public security or public health, other than a temporary exclusion order.]

(3)A person commits an offence if he—

(a)does an act which assists the individual to arrive in, enter or remain [F4, or attempt to arrive in, enter or remain, ] in the United Kingdom,

(b)knows or has reasonable cause for believing that the act assists the individual to arrive in, enter or remain [F4, or attempt to arrive in, enter or remain, ] in the United Kingdom, and

(c)knows or has reasonable cause for believing that the Secretary of State has [F5made an order excluding the individual from the United Kingdom on the grounds of public policy, public security or public health] .

(4)[F6Subsections (4) and (6)] of section 25 apply for the purpose of an offence under this section as they apply for the purpose of an offence under that section.]

[F7(5)In this section a “temporary exclusion order” means an order under section 2 of the Counter-Terrorism and Security Act 2015.]
