26 Pensions of Prime Minister and Speaker.

Any person who has (whether before or after the passing of this Act) been appointed Prime Minister and First Lord of the Treasury or elected Speaker of the House of Commons and has after 1st April 1972 (whether before of after the passing of this Act) ceased to be Prime Minister and First Lord of the Treasury, or ceased to be Speaker, as the case may be, shall, subject to the next following subsection, be entitled to receive a pension under this section.

No pension shall be payable under this section to any person so long as he is in receipt of any salary payable out of the Consolidated Fund or out of the revenues of the Duchy of Lancaster, or so long as he is in receipt of any salary payable out of moneys provided by Parliament other than a salary or allowance payable out of moneys so provided in respect of his membership of the House of Commons.

Subject to section 31 of this Act, the annual amount of a pension payable to a person under this section in respect of the office of Prime Minister and First Lord of the Treasury shall be equal to one-half of the annual amount of the salary payable in respect of that office at the time when that person ceases to hold it.

Subject to section 31 of this Act, the annual amount of a pension payable to a person under this section in respect of the office of Speaker of the House of Commons shall be equal to one-half of the annual amount of the salary payable in respect of that office at the time when that person ceases to hold it.

Any pension payable under this section shall be charged on and paid out of the Consolidated Fund.

C2C327 Pensions for dependants of Prime Minister or Speaker.

In relation to a person who has held office as Prime Minister and First Lord of the Treasury or as Speaker of the House of Commons at any time after 1st April 1972 (whether before or after the passing of this Act) and has died (whether before or after the passing of this Act) F3the designated provisions shall have effect as if—

a

at the time of his death that person had been entitled F21under a scheme made by the Minister for the Civil Service under paragraph 16 of Schedule 6 to the Constitutional Reform and Governance Act 2010 to receive a pension payable out of the Parliamentary Contributory Pension Fund in respect of service to which that paragraph applies

for the purposes of that scheme, that person’s basic or prospective pension were of an amount equal to his section 26 entitlement

c

references in the designated provisions to the trustees of the Fund were references to the F22Minister for the Civil Service .

For the purposes of subsection (1)(b), the amount of a person’s section 26 entitlement—

a

where at the time of his death he was entitled to receive a pension under section 26 of this Act (whether or not, by virtue of subsection (2) of that section, the pension was payable), is the annual amount of the pension to which he was entitled under that section at the time when he ceased to hold that office or (if later) on 28th February 1991, and

b

where at the time of his death he held office as Prime Minister and First Lord of the Treasury or as Speaker of the House of Commons, is the annual amount of the pension to which he would have been entitled under that section if he had ceased to hold office immediately before his death,

but in either case, any provision which deems such a pension to have begun on a day earlier than the day referred to in section 8(2) of the Pensions (Increase) Act 1971 shall be disregarded.

For the purposes of subsection (1) above the designated provisions are such of the provisions contained in F23a scheme made by the Minister for the Civil Service under paragraph 16 of Schedule 6 to the Constitutional Reform and Governance Act 2010 as—

a

have effect for the purposes of, or in connection with, the payment out of the Parliamentary Contributory Pension Fund of a pension in respect of service F24to which that paragraph applies

i

to the F6widow, widower or surviving civil partnerF6 of a person with such service; or

ii

for the benefit of any children of any person; and

b

are designated for the purposes of this section by regulations made by the F25Minister for the Civil Service.

The power to make regulations designating any provisions for the purposes of this section shall be exercisable by statutory instrument subject to annulment in pursuance of a resolution of either House of Parliament.

Any pension payable under this section shall be charged on and paid out of the Consolidated Fund.

In this section—

  • children ” includes adopted children, stepchildren and illegitimate children; and

28 Pension of Lord Chancellor.

F91

Subject to section 31 of this Act, the annual amount of any pension granted under section 3 of the Lord Chancellor’s Pension Act 1832 shall, in the case of a person resigning the office of Lord Chancellor, be equal to F10one-half of the annual amount of the salary which, at the time when he ceases to hold that office, is payable to a holder of that office who is not also Speaker of the House of Lords.F10

In accordance with the preceding subsection section 3 of the M1Lord Chancellor’s Pension Act 1832 shall be amended by substituting, for the words “£6,250 of lawful money of Great Britain” and for the words “the sum of £6,250”, the words “an amount calculated in accordance with subsection (1) of section 28 of the Parliamentary and other Pensions Act 1972 and the provisions (other than this Act) referred to in that subsection.”

Any Letters Patent issued under that Act before the passing of this Act shall have effect subject to subsection (1) of this section.

That Schedule shall also be amended as follows, that is to say—

a

by inserting at the end of paragraph 1 the words “or under section 26 or 27 of the Parliamentary and other Pensions Act 1972 (pensions of Prime Minister and Speaker and their Dependants)”;

b

by inserting at the end of paragraph 2 the words “as amended by section 28 of the Parliamentary and other Pensions Act 1972”; and

c

by inserting at the end of paragraph 3 ther words “or (except in respect of any period ending before 1st April 1972) under M2Mr. Speaker King’s Retirement Act 1971”.

In section 5(3) of the M3Pensions (Increase) Act 1971 (which confers power to make regulations modifying the provisions of that Act in relation to particular official pensions) the reference to the provisions of that Act shall be construed as including a reference to those provisions as they have effect in consequence of the amendments made by the preceding subsections.

In the preceding provisions of this Act any reference to this section shall be construed as a reference to the provisions of the Pensions (Increase) Act 1971 as amended by this section . . . F15 and as modified by any regulations made under section 5(3) of that Act as read with subsection (3) of this section.

35 Interpretation (general).

In this Act, except in so far as the context otherwise requires, the following expressions have the meanings hereby assigned to them respectively, that is to say—

  • the Act of 1965” means the M4Ministerial Salaries and Members’ Pensions Act 1965;

36 Amendments, repeals and savings.

The repeal shall not affect the operation—

a

of subsections (1) to (3) of section 3 of the M5Ministerial Salaries Consolidation Act 1965 (pensions of Prime Ministers), or

b

of subsection (4) of that section (which relates to dependants of Prime Ministers) or of any provisions of the Act of 1965 as applied by that subsection,

in relation to any person who held office as Prime Minister and First Lord of the Treasury before 1st April 1972 but has not (whether before or after the passing of this Act) held that office at any time after that date.

37 Short title.

This Act may be cited as the Parliamentary and other Pensions Act 1972.
