Interests of owner-occupiers affected by planning proposals

C2186 Compensation for compulsory purchase of historic buildings and of land in clearance areas. C1

Where an interest in land is acquired in pursuance of a blight notice and the interest is one—

a

in respect of which a compulsory purchase order is in force under section 1 of the M1Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947 (as applied by section 104 of this Act) containing a direction for minimum compensation under section 107 of this Act; or

b

in respect of which a compulsory purchase order is in force under the said section 1 as applied by F2paragraph 5 of Schedule 8 to the Housing (Scotland) Act 1987;

the compensation payable for the acquisition shall, in a case falling within paragraph (a) of this section, be assessed in accordance with the direction mentioned in that paragraph and, in a case falling within paragraph (b) of this section, be assessed in accordance with F2paragraph 12(2) and (3) of Schedule 8 to the Housing (Scotland) Act 1987 in either case as if the notice to treat deemed to have been served in respect of the interest under section 185 of this Act had been served in pursuance of the compulsory purchase order.
