[F1146A Joint Authorities and Inner London Education Authority.E+W

(1)[F2Subject to [F3subsection (1A)] below,] a joint authority [F4, the London Fire and Emergency Planning Authority][F5F6. . . a police authority established under [F7section 3 of the Police Act 1996]][F8and the Metropolitan Police Authority][F9 shall each be] treated—

(a)as [F10a local authority] for the purposes of sections 111 to 119, 128 to 131, 135, 136, 139 (except sub-sections (1)(b) and (2) ), 140, 140A, 140C, 143 and 146 above; and

(b)as a principal council for the purposes of section 120 (except subsection (1)(b)) and sections 121 to 123 above.

[F11(1A)[F12Neither a] police authority established under [F7section 3 of the Police Act 1996][F13nor the Metropolitan Police Authority]. . . shall F14. . . be treated—

(a)as a local authority for the purposes of section 112, [F15or 139] above, or

(b)as a principal council for the purposes of section 122 above.]

[F17(1B)In their application by virtue of subsection (1) above to a police authority established under section 3 of the Police Act 1996 [F18or the Metropolitan Police Authority], sections 140A and 140C above shall have effect as if—

(a)in the definition of “voluntary assistant” in section 140A(2), the reference to the request of the local authority or an authorised officer of the local authority included a reference to the request of a member of the police force maintained by the police authority, and

(b)section 140C(1)(a) were omitted.

(1C)For the purposes of section 140A above as it applies to a police authority established under section 3 of the M1Police Act 1996 [F19or the Metropolitan Police Authority], a special constable acting as such is not to be treated as a voluntary assistant.]
