Local Government (Scotland) Act 1973

188Miscellaneous licensing, registration and related matters

(1)The local authority for the purposes of the [1940 c. 31.] War Charities Act 1940 (registration authority for war charities) and the [1972 c. 66.] Poisons Act 1972 (local authority's list of persons entitled to sell poisons) shall be a regional or islands council.

(2)The local authority for the purposes of the [1969 c. 27.] Vehicle and Driving Licences Act 1969 shall be a regional, islands or district council.

(3)For the purposes of the following enactments the local authority shall be an islands or district council—

(a)The [1909 c. 30.] Cinematograph Act 1909 ;

(b)The [1925 c. 38.] Performing Animals (Regulation) Act 1925 ;

(c)The [1925 c. 50.] Theatrical Employers Registration Act 1925 ;

(d)The [1937 c. 48.] Methylated Spirits (Sale by Retail) (Scotland) Act 1937;

(e)The [1939 c. 44.] House to House Collections Act 1939 ;

(f)The [1951 c. 35.] Pet Animals Act 1951;

(g)The [1952 c. 46.] Hypnotism Act 1952;

(h)The [1963 c. 43.] Animal Boarding Establishments Act 1963 ;

(i)The [1964 c. 70.] Riding Establishments Act 1964 ;

(j)section 44(1) of the [1966 c. 51.] Local Government (Scotland) Act 1966 (game licences);

(k)The [1968 c. 38.] Sale of Venison (Scotland) Act 1968 ;

(l)The [1968 c. 54.] Theatres Act 1968.

(4)In consequence of the foregoing provisions of this section the enactments mentioned therein shall have effect subject to the modifications and amendments set out in Part III of Schedule 24 to this Act.
