Textual Amendments
3U.K.Subject to paragraphs 4 and 5, a person shall hold and vacate office as the Chair or as another member according to the terms of the instrument appointing him to that office.
4U.K.The Chair or any other member of the Executive may at any time resign his office by giving notice in writing to the Secretary of State.
5U.K.The Secretary of State may remove a Chair or other member who—
(a)has been absent from meetings of the Executive for a period longer than six months without the permission of the Executive;
(b)has become bankrupt or [F2has had a debt relief order (under Part 7A of the Insolvency Act 1986) made in respect of him or] has made an arrangement with his creditors;
(c)in Scotland, has had his estate sequestrated or has made a trust deed for creditors or a composition contract;
(d)has become incapacitated by physical or mental illness; or
(e)is otherwise, in the opinion of the Secretary of State, unable or unfit to carry out his functions.]
