163 Compensation for loss.

(1)

Where, in exercising his powers under section 162, an officer of an enforcement authority seizes and detains goods and their owner suffers loss by reason of—

(a)

that seizure, or

(b)

the loss, damage or deterioration of the goods during detention,

then, unless the owner is convicted of an offence under this Act committed in relation to the goods, the authority shall compensate him for the loss so suffered.

(2)

Any dispute as to the right to or amount of any compensation under subsection (1) shall be determined by arbitration.
