Salaries and pensions of Comptroller, Parliamentary Commissioner and Health Service Commissioners

6Comptroller and Parliamentary Commissioner

(1)Section 1 of the [1957 c. 45.] Exchequer and Audit Departments Act 1957 (salary of Comptroller and Auditor General) and section 2 of the [1967 c. 13.] Parliamentary Commissioner Act 1967 (salary and pension of Parliamentary Commissioner) shall be amended as follows.

(2)For subsections (1) and (2) of the said section 1 there shall be substituted the following subsections—

(1)There shall be paid to the holder of the office of Comptroller and Auditor General the same salary as if he were employed in the civil service of the State in such appointment as the House of Commons may by resolution from time to time determine; and a resolution under this subsection may take effect from the date on which it is passed or from such other date as may be specified in the resolution.

(2)In relation to any time before the first resolution under subsection (1) above takes effect, the salary payable to the holder of the office of Comptroller and Auditor General shall be the same salary as if he were employed in the civil service of the State as a Permanent Secretary.

and those subsections shall also be substituted for subsections (1) and (2) of the said section 2 but modified for that purpose by the substitution of references to the Commissioner for references to the Comptroller and Auditor General.;

(3)For subsection (3) of the said section 1 there shall be substituted the following subsections—

(3)The salary payable to a holder of the office of Comptroller and Auditor General shall be abated by the amount of any pension payable to him in respect of any public office in the United Kingdom or elsewhere to which he had previously been appointed or elected.

(3A)In computing the salary of a former holder of the office of Comptroller and Auditor General for the purposes of section 13 of the Superannuation Act 1972 (pension of Comptroller and Auditor General)—

(a)any abatement of that salary under subsection (3) above,

(b)any temporary abatement of that salary in the national interest, and

(c)any voluntary surrender of that salary in whole or in part,

shall be disregarded.

(4)In subsection (4) of the said section 2 the words from " but any such abatement" to the end shall be omitted and after that subsection there shall be inserted the following subsection—

(4A)In computing the salary of a former holder of the office of Commissioner for the purposes of the said Schedule 1—

(a)any abatement of that salary under subsection (4) above,

(b)any temporary abatement of that salary in the national interest, and

(c)any voluntary surrender of that salary in whole or in part,

shall be disregarded.

(5)This section shall be deemed to have come into operation on 1st January 1975.

7Health Service Commissioners

(1)Section 32 of the [1973 c. 32.] National Health Service Reorganisation Act 1973 and section 43 of the [1972 c. 58.] National Health Service (Scotland) Act 1972 (salaries and pensions of Health Service Commissioners) shall be amended as follows.

(2)In subsection (1) of each section for the words " such salary " there shall be substituted the words " the same salary as if he were employed in the civil service of the State in such appointment ".

(3)In subsection (3) of each section the words from " but any such abatement" to the end shall be omitted and after that subsection there shall be inserted the following subsection—

(3A)In computing the salary of a former holder of the office of Commissioner for the purposes of the said Schedule 1—

(a)any abatement of that salary under subsection (3) above,

(b)any temporary abatement of that salary in the national interest, and

(c)any voluntary surrender of that salary in whole or in part,

shall be disregarded.
