Limitations on recovery of possession of dwelling-houses let on protected tenancies or subject to statutory tenancies

101Overcrowded dwelling-houses

(1)

At any time when a dwelling-house to which this section applies is overcrowded, within the meaning of the M1Housing Act 1957, in such circumstances as to render the occupier guilty of an offence, nothing in this Part of this Act shall prevent the immediate landlord of the occupier from obtaining possession of the dwelling-house.

(2)

This section applies to a dwelling-house which consists of premises used as a separate dwelling by members of the working classes or of a type suitable for such use.
