SCHEDULE 7 Transfer of Fine Orders

(1)
Section 403 of the M1Criminal Procedure (Scotland) Act 1975 shall be amended as follows.
(2)
In subsection (1)—
(a)
“,or
(c)
in any petty sessions district in Northern Ireland,”;
(b)
the words “if no term of imprisonment has been fixed by the court in default of payment of the fine” shall be omitted; and
(c)
after “petty sessions area” there shall be inserted the words “or petty sessions district”.
(3)
In subsection (2) after the words “petty sessions area” there shall be inserted the words “or petty sessions district”.
(4)
In subsection (4)—
(a)
for the words from “within” to M2“Magistrates’ Courts Act 1952” there shall be substituted the words “under this section, section 72A of the Magistrates’ Courts Act 1952 or section 104A of the Magistrates’ Courts Act (Northern Ireland) 1964”; and
(b)
for the words “or the said Act of 1952” there shall be substituted the words “, the said Act of 1952 or the said Act of 1964”.
(5)
Subsection (5) shall cease to have effect.
(6)
In subsection (6) after the words “section 72A of the Magistrates’ Courts Act 1952” there shall be inserted the words “section 104A of the Magistrates’ Courts Act (Northern Ireland) 1964”.
