(1)[F1Subject to subsection (1A) below] all applications made [F2by medical practitioners in the prescribed manner to a [F3Health Authority] for inclusion in a list kept by [F3the Health Authority of] the names of medical practitioners undertaking to provide general medical services for persons in the [F3Health Authority’s area] shall be referred by [F3the Health Authority]] to the Medical Practices Committee and . . . F4 any medical practitioner whose application is granted by [F3the Committee shall][F5subject to the provisions of this Part of this Act relating to disqualification of practitioners] be entitled to the inclusion of his name in the list.
[F6(1A)No medical practitioner who is a national of a member State and is registered by virtue of a qualification granted in a member State shall be entitled to have his application for the inclusion of his name in the list kept by any [F7Health Authority] referred to the Medical Practices Committee unless he satisfies the [F7Health Authority] that he has that knowledge of English which, in the interests of himself and his patients, is necessary for the provision of general medical services in the [F7Health Authority’s area]; and where a [F7Health Authority] is not so satisfied with respect to any applicant the [F7Health Authority] shall not refer his application to the Medical Practices Committee.]
